These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") apply to any order (hereinafter referred to as the "Order") for one or more products (hereinafter referred to as the "Product(s)") placed by the purchaser (hereinafter referred to as the "Customer") on the merchant website www.Heiko-Poke.com. (hereinafter the "Site") from one of the participating Heiko Restaurants (hereinafter the "Seller", the "Restaurant").
Click & Collect on the Site are reserved for customers aged 16 or over on the date the order is placed.
These General Terms and Conditions shall prevail over any other general or special terms and conditions not expressly approved by the Seller.
The Vendor reserves the right to modify the GCS at any time. In all cases, the applicable GCS will be those appearing on the Site at the date of the Customer's Order.
In these T&Cs, the following words or expressions shall have the following meanings:
The Customer hereby declares that he/she has read and accepted these General Terms and Conditions of Sale before placing his/her Order. By placing an Order for a Product on the Site or the Application, the Customer acknowledges acceptance of these General Terms and Conditions of Sale.
The products offered by the Restaurant chosen by the Customer are those appearing on the menu published on the www.heiko-poke.com website by our service providers Innovorder or Zelty on the day of the Order, subject to availability. It is recommended that products be kept in a cool place from the time they are collected from the Restaurant or delivered. We strongly advise you never to freeze Products.
The products presented for sale in our menus are subject to change or withdrawal by the Heiko without notice.
We may collect data about you from other companies and entities, including public databases, social networks or third-party partners such as analytics or marketing service providers. We may also collect publicly available information, such as your profile, when you interact with us on social networks. The latter also enable us to collect communications addressed to us or concerning us.
We may combine the data you provide with data collected by automated means and from other sources.
To order, the Customer must create an account on the Innovorder or Zelty partner site.
When registering, the Customer chooses a login and a password. Customers must associate their login with a valid e-mail address.
It is the Customer's responsibility to keep this information strictly confidential and not to communicate it to third parties, in order to avoid as far as possible any risk of intrusion into the Customer's account and the placing of Orders without the Customer's knowledge by unauthorized persons. The Vendor shall not be held liable for any use of the Customer's account by a third party who has gained access to the Customer's login and password in any way whatsoever.
When registering, the Customer will be asked to provide certain compulsory information, in particular his/her surname, first name, cell phone number and e-mail address. This list is exhaustive.
If the Customer loses or forgets his/her password, he/she can click on the link. The customer will receive an e-mail from our partner site to the e-mail address previously provided, reminding them of their password. This password modification procedure is defined in the conditions of use of the partner site Innovorder or Zelty.
Click & Collect :
To order online and collect the Order from the Restaurant, the Customer must :
Following payment by the Customer and validation of the Order, the Vendor will send the Customer confirmation of the Order recorded on the Site by e-mail, together with an Order number.
The online provision of a credit card number, the final validation of the Order and the express acceptance by the Customer of these GTCs imply the acknowledgement of full knowledge of them and the waiver of the Customer's own conditions of purchase or any other conditions.
The Customer must collect his Order from the Restaurant on the day it is validated on the Site and before the closing time of the Restaurant he has selected.
Click & Collect opening times and the opening times of the Restaurant where the Customer wishes to collect his/her Order are available on the Site and on Google Maps at the time the Customer selects the Restaurant.
Delivery orders
To receive his Order delivered, the Customer must :
Create an account or log in to your account with your username and password
- go to www.heiko-poke.com
- select a Restaurant offering the Delivery service:
- enter or choose the address to which the Order will be delivered:
- place an Order by selecting the Products,
- validate his Order after having checked the summary of his Order,
- accept the GTC and the General Conditions of Use of the Company Delivery
- pay for your Order online
The Vendor then sends the Customer confirmation of the Order by e-mail.
The Customer will be able to track the progress of his Order via the partner's website and will be able to obtain an indicative estimated delivery time thanks to the information provided by the partner. Company Delivery. Under no circumstances may the Customer choose the delivery time.

Delivery service schedules are available on www.heiko-poke.com or the partner site Innovorder or Zelty at the time the Customer selects the Restaurant.
The Customer will be informed on www.heiko-poke.com, at the time of a Delivery Order, that certain Products or offers are not available and in particular, without this list being restrictive and definitive.
The online provision of the credit card number and the final validation of the Order shall constitute proof of the completeness of the said Order and shall constitute payment of the sums involved in the Order.
The Vendor will archive order forms and invoices on a reliable and durable medium, via the partner site Innovorder or Zelty.
The Vendor's computerized records will be considered by the Vendor as proof of communications, orders, payments and transactions between the parties. In the event of disagreement, it is up to the Customer to provide proof to the contrary.
6.1 Cancellation and modification of a Click & Collect Order
According to the provisions of article L.221-28 4° of the French Consumer Code, the right of withdrawal applicable to distance selling cannot be exercised in the case of the supply of goods which, due to their nature, are likely to deteriorate or expire rapidly.
In application of this text, it is expressly indicated that any Order on the Site and/or the Application is firm and final and that the right of withdrawal is totally excluded.
Orders that have been definitively validated, paid for and withdrawn cannot be cancelled.
No goods may be returned or exchanged.
6.2 Cancellation and modification of a Delivery Order
Delivery Orders that have been validated and paid for cannot be modified. However, they may be cancelled prior to acceptance of the Delivery by the Deliverer.
Once the Delivery Order has been accepted by a Delivery Driver, the Customer may no longer cancel the Order.
The Products can only be collected from the Restaurant selected by the Customer from the opening time of the Restaurant and before the closing time of the Restaurant or the closing time of the Click & Collect service set by the Restaurant selected.
The opening hours of the Restaurant where the Customer wishes to collect his/her Order are available on the www.heiko-poke.com website.

Customers may only collect their Products from the Restaurant they have previously selected when placing their Order on the www.heiko-poke.com website using their Order number, which appears on the order confirmation e-mail in the case of a Click&Collect order. The Vendor will provide the Customer with a paper or digital receipt.
In the event that the Customer fails to collect an Order placed using the Click & Collect service on www.heiko-poke.com, the Customer will be invoiced (non-refundable) for the price of the Order and the Order will be cancelled. It is reminded that no delivery will be made by the Vendor outside the delivery service available on the website.
Delivery is carried out by the carrier selected by Company Delivery (Uber Direct or Stuart) acting on its behalf and under its sole responsibility.

General Terms and Conditions Company Delivery (Uber Direct or Stuart) must be read and accepted prior to any Delivery request.
8.1 Description of the delivery service
By confirming a Delivery request on www.heiko-poke.com via the partner site Innovorder or Zelty, the Customer asks a Delivery Driver to deliver the Products ordered on his behalf and under his sole responsibility.
The customer's delivery request is sent to the delivery driver via the module designed by the Uber Direct or Stuart platform. The customer is connected directly to the platform via the Application, without having to open an account with Uber Direct or Stuart. Company Delivery.
When requesting a Delivery, the Customer must indicate his/her name, the desired delivery address and telephone number with all the details necessary to enable the Supplier to deliver to the right person at the right address. In order to enable Delivery, the Customer must refrain from requesting Delivery to a recipient who is inaccessible or who would require considerable effort on the part of the Supplier.
The Delivery address provided by the Customer must be within a maximum radius of 3.5km of the Restaurant selected by the Customer when ordering Products for delivery and which will prepare the Order.
Delivery may only be made for one Order at a time.

Service and delivery charges are invoiced by the Delivery Company (Uber Direct or Stuart) in the name and on behalf of the Deliverer, according to the scale indicated below.
8.3 Delivery times
The customer is informed of the status of his delivery request via the delivery module.
The Supplier shall use his best efforts to deliver the Products to the Customer, without any firm commitment on his part in view of the hazards and risks involved.
If the Order is not delivered as soon as possible, the Customer may contact the Supplier via the Application, in the "order tracking" tab, to find out whether a problem has occurred.
If the Supplier is unable to make the Delivery, the Customer is informed by means of a notification on the module. In this case, the Customer will not be debited for the amount paid.
Claims relating to the delivery service
Any questions or complaints regarding the delivery service should be directed to www.heiko-poke.com via the online form accessible on the Site in the "Contact" section. The customer must select "Direct delivery problem" from the drop-down menu and indicate the order number in order for the complaint to be processed.
Product-related claims
Any questions or complaints concerning Products collected from Restaurants should be made to www.heiko-poke.com via the online form accessible on the Site in the "Contact" section. In order to process a complaint, the customer must provide his/her surname, first name and order number.
Any questions or complaints about the operation of the www.heiko-poke.com site should be made using the online help form accessible on the application in the "Contact" section.
The prices shown on the Site's Order pages are inclusive of all taxes in euros and include the VAT applicable on the date of the Order.
The Vendor reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the menu on the day of the Order will be the only applicable price.
Orders placed on the Site (via the partner site Innovorder or Zelty) are payable using the means of payment offered by the selected restaurant (credit cards, etc.).
The Vendor guarantees the confidentiality of credit card numbers by means of protection and encryption procedures via the payment module.
In the online sales process, the Vendor is bound only by an obligation of means. The Vendor cannot be held responsible for any damage of any kind, whether material or immaterial, which may result from improper use of the identifier or the ordering procedure. The Vendor may not be held liable for any risk inherent in the use of the Internet, such as loss of data, intrusion, virus, service interruption or any other similar risk.
In the case of a Delivery Order, Delivery is carried out by the Deliverer in his own name and under his sole responsibility. Consequently, the Vendor cannot be held liable for any damage resulting from the Delivery service.

Within the framework of a Delivery Order, certain personal data entered by the Customer on the Application are collected by the latter and transmitted to the Company Delivery (Uber Direct or Staurat). Visit Company Delivery processes the aforementioned personal data in accordance with the instructions on its website and its Privacy Policy, in order to enable it to process the delivery request (exclusively for the purpose of establishing contact with a delivery person and invoicing in the name of and on behalf of the delivery person) and, where applicable, to establish contact with a service provider in order to manage the customer's complaints concerning the order of Products for delivery, in particular by establishing contact with the Restaurant and/or the delivery person.
Customers have the right to access, rectify, post-mortem and, for legitimate reasons, delete personal data concerning them and communicated to the Company Delivery.
Customers may exercise their rights by sending a request via the links above.
In accordance with articles L.223-1 et seq. of the French Consumer Code, the Customer may, at any time, register his telephone number on the opposition list against telephone canvassing if he does not wish to be canvassed by telephone on the number he has communicated to Heiko, by Internet on the site www.bloctel.gouv.fr or by post by writing to : Société Opposetel, Service Bloctel, 6 rue Nicolas Siret 10000 Troyes. Any person registered on this list may not be contacted by telephone by Heiko or one of its partners. Registration is free and valid for three years.
The sale of alcoholic beverages is only possible if accompanied by the sale of at least one poké dish for an alcoholic beverage.
In accordance with the provisions of article L3342-1 of the French Public Health Code, amended by law no. 2009-879 of July 21, 2009, the sale of alcohol to minors under the age of eighteen (18) is prohibited. Consequently, the purchase of any alcohol-based product during the Order process is strictly forbidden to minors under the age of eighteen (18). In case of doubt, the Customer may be asked to show proof of identity when picking up his or her Order in the Restaurant.
Alcohol abuse is dangerous for your health.
The nullity of any of the clauses of these GCS, in particular in application of a law, a regulation or following a court decision, shall not entail the nullity of these GCS.
These terms and conditions are governed by French law. In the event of a dispute, the dispute will be submitted to the French courts.
In the event of a dispute, the Customer may first contact the Vendor to seek an amicable solution.
The offer is valid only for students who want to eat on site or à take away on presentation of the student card for the current academic year and validated at the price of 10 euros incl. VAT.
The "MENU ETUDIANT" offer is not valid on delivery platforms or on the heiko-poke.com website.
Only the following pokés are available in the Small size offer : Halea Small - Copal Small- Waimea Small- Kalua Small- Krevet Small+ one drink included in the formula (excluding beer and premium drinks).
The Children's Menu is valid only for children aged 3 to 10 who wish to eat in or take away for €8.90 incl. VAT. The "Children's Menu" offer is not valid on delivery platforms (Uber Eats & Deliveroo), nor on the Heiko Poké website accessible at the following address: https://www.heiko-poke.com.
The "Children's Menu" offer includes :
- 1 Small Poké Kompow with: 2 crudités, 1 protein, 1 sauce and 1 topping (seeds).
- 1 drink from the Vittel or San Pellegrino range only. For all other beverages, a surcharge of €1 (incl. VAT) applies.
- 1 dessert included in formula, depending on desserts available in restaurant.
- 1 surprise gift, subject to availability.
The Heiko Poké Merchant-Neighbor loyalty program is valid only for retailers near our pokés spots. By joining the Commerçant Voisin program, customers benefit from a discount of -10% valid on a maximum of one order per day for a renewable period of 6 months, on site at the restaurant and online via the website heiko-poke.com.
To benefit from this advantage, customers must register for our loyalty program using a special Qrcode available on the flyer distributed to them by the Heiko restaurant teams, and then present proof in the restaurant that they are a neighboring merchant of their Heiko poké spot of reference. After validation by our teams, the customer is entitled to the "-10% NEIGHBORLY TRADER" offer for a period of 6 months from the date of activation of the Neighborly Trader program. At the end of this period, the neighboring merchant receives a message inviting him/her to present a receipt at the checkout in order to benefit from the offer for a further 6 months.
20.1 - Definitions :
- Neighboring merchant": means a person working in an entity offering goods and/or services in the direct vicinity (distance: 300 meters circular with the restaurant's address as the starting point) of the restaurant and welcoming the public.
- Beneficiary": in the singular, refers to the customer benefiting from the Commerçant Voisin loyalty program offer.
- Offer -10%": refers to the promotional code worth 10% valid on one order per day after registration in the Commerçant Voisin loyalty program.
- "Site": refers to the Heiko Poké website accessible at the following address: https://www.heiko-poke.com.
20.2 - Conditions of registration for the Commerçant Voisin loyalty program :
Registration for the Commerçant Voisin loyalty program is free.
It is expressly specified that only one registration per person will be authorized. Each beneficiary may hold only one account. The Commerçant Voisin loyalty account is strictly personal and non-transferable. The presentation of an identity document could be required to validate the membership to the program and at the time of the passage in cashier.
Physical proof that the beneficiary is a neighboring merchant must be presented at the checkout to validate membership of the Commerçant Voisin loyalty program (e.g. employee badge, business card, etc.). The restaurant reserves the right to check the authenticity of the document and/or refuse it.
The restaurant reserves the right to refuse membership of the Commerçant Voisin loyalty program to any person who does not meet the criteria defined above. For example, a shopkeeper operating within a radius of more than 1km from the Heiko restaurant is not eligible for this program and will be refused membership of the Commerçant Voisin loyalty program. They may, however, register for the standard loyalty program.
20.3 - Changes to the Commerçant Voisin loyalty program :
Heiko poké reserves the right to suspend, cancel or modify the Merchant-Neighbor program and/or to review and revise the TOU at any time.
20.4 -Acceptance of the GCU :
To benefit from the Commerçant Voisin loyalty program, the beneficiary must accept the Terms and Conditions, which are available at registration and on https://heiko-poke.zerosix.com/#/.
By accepting the GCU, the beneficiary undertakes to comply with the various obligations set out therein.
The beneficiary agrees to carefully read the Terms and Conditions when registering for the Commerçant Voisin loyalty program.
